  Are Magistrates listening?

  
We have just been fed another load of bluster from the State Government about how serious they take assaults on members of our Indian community in particular. This was a knee jerk reaction because of one thing. Money!

They were never going to do anything about the constant bashings we read about every week because firstly they don't have the Police to apprehend the offenders, nor do they have the backing of our Judiciary when it comes to handing down a morally just penalty.

As a classic example just look at what Magistrate Kay Macpherson handed out to five animals for want of a better word, who bashed Indian student Sukhraj Singh almost to death.
She said they "acted like a pack of animals" and with words like that you would think that they would feel the full force of the Law.

  Inconsistency with Magistrates

  
In this weeks paper we read about cases where decisions were made by Magistrates that were not only insulting they bordered on the obscene.

One case involved a 16 year old youth who appeared before Magistrate Rowan McIndoe on a rape charge,and it would not have made the papers if not for a Supreme Court Appeal on the judgement of the magistrate in which he decided the offence was "an adolescent error".
As is the case with most Childrens Court hearings they are hidden under the obscene veil of secrecy and dont appear in the public domain as they should for serious crimes such as this. Read the rest ...

  Callous Thief De Stefano

  
Frank De Stefano, who was once the mayor of Geelong and one of it's elite citizens and who was able to con enough people into thinking he was a super Accountant, will be released from prison shortly to serve out the remainder of his sentence under home detention.

Now we have been quite vocal in the past about who should get such a penalty and were responsible for getting Glen Wheatley his home detention wish, but in this case De Stefano has been given a penalty that wont cause him too much grief I am sure. Read the rest ...

  No jail time for brutal bashing

   A recent case heard on the Gold Coast just proved how out of touch our Judiciary are when it comes to violent behaviour. We are continually told that we have the safest country in the world and that our Justice system is designed to protect the public from offenders who dont want to conform with society's Laws, but then you read about how a Judge gives a violent offender a sentence that not only disgusts the victim, it basically says that if you have a medical problem you are not responsible for the crimes committed.   Honeymoon killer 'manipulative'

   He has been described by friends and colleagues as a kind and generous man, but victim impact statements paint honeymoon killer Gabe Watson as a controlling and manipulative husband.

American David "Gabe" Watson, 32, will be free in 11 months to return to his life and new bride in his home state of Alabama after pleading guilty to manslaughter in a Brisbane court last Friday.

His dead wife's family were outraged over the "ludicrous" sentence for what they claimed was the murder of their beloved daughter, Christina "Tina" May Watson, 26. CourierMail full story
